Just In: SCOTUS Blocks Request to Vacate Hill’s Stay of Execution

The U.S. Supreme Court has denied Georgia’s request to lift the Eleventh Circuit Court of Appeals’ stay of Warren Hill’s execution.

In a statement, Hill’s attorney, Brian Kammer said, “The Eleventh Circuit briefing schedule will now be followed over the next month to determine whether Mr. Hill can litigate a second federal habeas action on his claim of mental retardation given the newly available evidence which establishes consensus among every doctor who has evaluated Mr. Hill that he is mentally retarded.”

The state entered its motion Wednesday, saying that the circuit court’s stay was “improvidently granted” because Hill’s defense of an intellectual handicap had already been raised.
